GENERAL TERMS AND CONDITIONS OF USE
By entering into an agreement between the operator and the user regarding the use of the website www.ihelpsos.com or the iHELP mobile application, you agree to these general terms and conditions. If you do not agree with these general terms and conditions, do not use the website www.ihelpsos.com, www.ihelp.life, or the iHELP mobile application.
GENERAL
Operator: The operator is iHELP Life d.o.o., Vrtnarija 8b, 1360 Vrhnika, Slovenia, Europe.
User: A user is any natural person who uses the website www.ihelpsos.com, www.ihelp.life, or the iHELP mobile application
CONCLUSION OF THE AGREEMENT
The agreement between the operator and the user regarding the use of the website www.ihelpsos.com or the iHELP mobile application for the free service "iHELP Safety Package: BASIC" is concluded when the user registers and creates their iHELP profile (user account). For the paid subscription packages "PLUS" and "PREMIUM", the agreement is concluded when the user registers, creates their user profile, and pays the annual subscription fee to the operator. Upon payment of the annual subscription, the agreement is concluded for a period of one year. The agreement can be extended by paying the annual subscription fee for the following year.
USER REGISTRATION
The user logs into the iHELP system on the website www.ihelpsos.com using a username and a chosen password. The user password is confidential and known only to the user. The user is responsible for safeguarding their password. The operator shall not be liable for any loss or damage arising from the user's failure to comply with this security obligation.
A user who registers via the website www.ihelpsos.com or the iHELP mobile application activates their iHELP account (validates their mobile phone number) and fills in their personal data (first and last name, address, email address, phone number). In their profile, the user may also provide information regarding their medical condition (age, weight, height, blood type, illnesses, medications taken, allergies, whether they have a pacemaker inserted, etc.). The user is responsible for the accuracy and timeliness of the personal data and for the content published in their profile. In the event of changes, the user is obliged to immediately and appropriately update the published content. The user can change their profile information in the following ways: via the mobile application, by registered mail to the operator's address, via email to the operator, or through the website www.ihelpsos.com.
PROTECTION OF PERSONAL DATA
The operator is committed to protecting the confidentiality of information obtained from users of the website www.ihelpsos.com or the iHELP application.
The operator collects personal data (such as personal names, addresses, email addresses, phone numbers, age, blood type, illnesses, medications taken, allergies, whether a pacemaker is inserted, etc.) that the user voluntarily provides in their profile. By providing personal data, the user explicitly agrees that the operator may use it in accordance with these general terms and conditions.
The purpose of collecting data on the users' medical condition is to enable emergency responders or other users of the iHELP mobile application to obtain data about the user who is in urgent need of assistance when an SOS message is sent.
The user can independently enable or disable the settings for the circle of individuals (emergency responders – iHELP mobile application users – relatives) to whom an SOS message containing their data will be sent in the event of an emergency. If the circle of individuals "Users of the iHELP mobile application" is selected, the message will be sent to all users of the iHELP mobile application located within a radius of 500 meters or more from the user in need of urgent assistance. By selecting the circle of individuals for SOS message notifications, the user explicitly agrees and consents to certain personal data being sent to all such individuals.
The operator may use user data solely to inform users about new services, similar activities, and news from the operator. The operator will not transfer the data to third parties or misuse it. The data is stored exclusively for rescue purposes (sending SOS messages and application usage). The operator will not forward the data to third parties, except upon request by a court or law enforcement authorities in the event of an attempted server breach.
The operator retains the personal data of users only for the duration that the user remains active, meaning while they have an activated profile and user account.
The operator* maintains appropriate technical and organizational security standards designed to protect the collected personal data of users against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use.
The user has rights under applicable legislation, which may include access to their personal data processed by the operator, the right to rectify, erase, or block the use of such personal data, and the right to object to specific methods of data processing. To exercise these rights, a written request from the user is required, addressed in accordance with the instructions below in the "Questions" section.
USAGE TRACKING ("Cookies")
The operator automatically tracks the usage patterns of the content accessible on the operator's website www.ihelpsos.com. This means that the operator may collect and process data regarding visits to the website www.ihelpsos.com, for instance, for visitor statistics and user registration ("login") purposes. During this process, a so-called "cookie" will be installed on the user's computer, through which the operator obtains data concerning the user's domain name, the user's internet service provider, and the date and time of the user's access. A "cookie" is a piece of information sent to the user's browser and stored on the computer's hard drive, enabling the operator to track the use and visitation of the website www.ihelpsos.com in greater detail. If the user disables or deactivates "cookies," they will still retain exactly the same access to the content on the website www.ihelpsos.com; doing so will only result in slightly less accurate data regarding website visitation and usage, which the operator collects for internal reports. This visitation data will be used strictly for the operator's internal purposes.
PRIVACY PROTECTION OF MINORS
The website www.ihelpsos.com and the iHELP application are not intended for children and youth under the age of 14. Children under the age of 14 are not permitted to transmit personal data via the website or the application. The operator does not store personal data of individuals under the age of 14.
PAYMENTS
The pricing for iHELP premium services is available on the website www.ihelpsos.com.
LIMITATION OF OPERATOR'S LIABILITY (DISCLAIMER)
The application effectively increases the chances of rescue and reduces the time required to provide first aid. By transmitting an SOS message, the iHELP application connects the user to the nearest emergency medical service via the 112 emergency number.
The iHELP application does not guarantee survival or a response to a request for help. The iHELP application increases the probability of survival and the possibility of a rapid rescue. The application itself does not save lives – people save lives.
The iHELP application, along with the information and content within the application, is not intended to replace or substitute professional medical assistance, emergency medical care, an official first aid course, or training in basic life support (CPR). The application is not intended to replace or substitute medical personnel.
The operator endeavors to ensure the full technical functionality of the website www.ihelpsos.com as well as the iHELP mobile application. The operator shall not be liable for any direct or indirect damage or inconvenience that the user might experience due to potential technical issues or interruptions in the operation of the iHELP mobile application.
The user agrees that the operator shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary material or immaterial damages arising from the user's use of the website www.ihelpsos.com or the iHELP mobile application.
The operator does not guarantee the flawless operation of the iHELP mobile application nor the accuracy of the transmitted information. Errors may occur in the operation of the application itself, as well as in the use of navigation systems (user's GEO-location) due to local environmental conditions and/or incomplete or incorrect data. In the event that the user has disabled GEO-location, the iHELP mobile application cannot transmit the user's GEO-location in the SOS message to responders, meaning that responders will not be notified of the location of the victim or the third party in need of urgent assistance.
The iHELP application successfully sends an SOS message to the selected circle of individuals (emergency responders – iHELP mobile application users – relatives) only if a working or accessible GSM signal is available. If the user is located in an area not covered by a GSM signal, or if the GSM signal is down, the SOS message will not be sent, and the operator shall not be liable for any inconvenience or damage incurred by the user as a result.
When a user sends an SOS message, the iHELP mobile application notifies them of the nearest defibrillator location. The operator acquired a portion of the list and locations of defibrillators from the website www.ihelp.life, managed by the iHELP d.o.o., and from other databases. Therefore, the operator does not guarantee the location of the defibrillators nor their flawless operation, and the operator shall not be liable for any direct or indirect damage or inconvenience that the user might experience due to the malfunction or incorrect location of defibrillators.
PROHIBITION OF MISUSE AND SANCTIONS
It is strictly prohibited to use the iHELP mobile application for any purpose other than rescue operations. Misuse of distress and danger signals (SOS messages) constitutes a criminal offense under Article 309 of the Slovenian Criminal Code (KZ-1). In the event of misuse of the iHELP mobile application, the user shall personally bear all costs associated with the emergency response intervention.
If misuse is detected, the operator shall block the user's SOS message transmission service and notify them via the mobile application, by registered mail to the user's address, or via email.
The user shall also be held liable for any misuse of the mobile application and SOS messages in the event of loss or theft of the medium or "smart" mobile device on which the iHELP mobile application is installed. In the event of loss or theft of the medium or "smart" mobile device on which the iHELP mobile application is installed, the user is obliged to notify the operator as soon as possible, so that the operator can block the SOS message transmission service and thereby prevent potential misuse.
CHANGES TO THE GENERAL TERMS AND CONDITIONS
The operator reserves the right to update and amend the price list as well as the general terms and conditions of use for the website www.ihelpsos.com or the iHELP mobile application. Continued use of the services after any such changes takes effect shall constitute the user's explicit consent to these modifications. If the user does not agree with the amended general terms and conditions or the price list, they may terminate their user account at any time; however, the subscription fee paid for the current year shall not be refunded to the user.
The operator shall notify users of any change to the price list 1 month prior to the amendment via the mobile application or via email.
GOVERNING LAW
The laws of the Republic of Slovenia shall govern the assessment of legal relations regarding these general terms and conditions in connection with the use of the website or the iHELP mobile application.
In the event of any dispute between the user and the operator, the courts of the Republic of Slovenia shall have exclusive jurisdiction.
